Access to the website
This legal warning (hereinafter "the Legal Warning") regulates the use of the site (hereinafter "the Service") that Sensofar-Tech S.L. (hereinafter "Sensofar") provides for Internet users at the following URL: www.sensofar.com (hereinafter "the Site"). Access to the Site is subject to users reading and accepting the Legal Warning and implies the status of user (hereinafter "the User") and the full and unconditional acceptance by said User of all the terms stated in the Legal Warning, as specified in the version published by Sensofar at the moment when the User accesses the Service.
To contact Sensofar via the form provided, the User must first provide Sensofar with personal information. The filling in and sending of said form implies that the User accepts and authorises the use of this personal information by Sensofar, as stated in the privacy policy published in the "Privacy" section on the Site. Sensofar reserves the right to verify the fulfillment of the Legal Warning by the User by means of any computer devices and techniques for Internet monitoring or any other method that might be used to verify the information provided, in order to ensure the proper use of the Service by the User.
The User explicitly and unconditionally accepts that the access to and use of this website takes place under his or her own exclusive responsibility.
The User must use the Site and its content in a diligent and proper manner, in accordance with the law, the terms of the present Legal Warning and any other aforementioned regulation that may be applicable, and in the interests of good practice and public order.
Similarly, the User is obliged to refrain from using the Site and its content in any way that may harm the rights or interests of third parties, or in any way that may harm, render useless, saturate or damage the website and its services or prevent the conventional use and enjoyment of the website by other users.
The User must refrain from modifying or manipulating the copyright statements and other data that specifies Sensofar's intellectual property rights or those of the owners of the content of the Site, as well as the technical protective devices, digital signatures or any other instruments used to protect the content. It is forbidden for the User to authorise the complete or partial use of the Site by third parties or for the User to incorporate the services and products offered on the Site into his or her own commercial activity, unless previously agreed to by Sensofar.
The Service
The Service is defined as all the services provided by Sensofar on the Site, which are currently the following: Marketing of optical metrology devices and metrology services and consulting.
Also included are the dissemination of articles, case studies, information and in general any technical and scientific material on optical metrology (hereinafter "the Content") provided by Sensofar.
Proper use of the Content
The User is obliged to use the Content properly and in a law-abiding manner and specifically to refrain from (a) using the Content in an immoral or illegal manner, (b) providing public access to the Content by any public or private media, (c) removing, avoiding or manipulating the copyright and other data that identifies the rights of Sensofar, and (d) reproducing, copying, altering, modifying or divulging the Content provided through the Service in any way to unauthorised third parties or selling any information obtained from the Service.
All of the Site's content (including, without restrictions, texts, graphics, icons, databases, images, text files, audio and video material and software) is the rightful property of Sensofar or of other content providers, and is protected by national and international regulations on industrial and intellectual property. The compilation (including the collection, ordering and assembly) of all the website's content is the exclusive property of Sensofar and is protected by national and international regulations on industrial and intellectual property.
The unauthorised reproduction, modification, copying, use, distribution, marketing, public communication and any other use of the information featured on the Site (including its design, configuration and presentation) constitutes an infringement of the prevailing legislation governing intellectual property rights.
Responsibility for damage and loss
The User will be responsible for any damage and loss that Sensofar may suffer as a direct or indirect consequence of the infringement of any of the obligations derived from the Legal Warning or from the law in relation to the use of the Site.
Use of the Service under the exclusive responsibility of the User
The User is aware and voluntarily accepts that the use of the Service and its Content takes place, in all cases, under the User's exclusive responsibility. Sensofar will not be held responsible for the consequences arising from the use of the Service and will not accept any responsibility arising from its Content.
Sensofar does not guarantee the availability and continuity of the Service.
Furthermore, Sensofar does not guarantee the absence of viruses and other elements in the Content that may lead to alterations in the User’s computer system (software and hardware) or in the electronic documents and files stored on the User’s computer. Sensofar denies responsibility for any damage or loss that may arise as a result of the presence of viruses or any other harmful elements in the Content provided by Sensofar that may result in modifications in the User's computer system.
Sensofar will identify clearly the information serving advertising purposes.
Privacy in the use of the Service
Sensofar does not guarantee privacy and safety in the use of the Service and, in particular, does not guarantee that unauthorised third parties will not become aware of the type, conditions, characteristics and circumstances associated with the use of the Service by its Users. Sensofar denies responsibility for any damage or loss that may arise as a result of the knowledge of unauthorised third parties of the use of the Service by its Users.
Denying and withdrawing access to the Service
Sensofar reserves the right to update the content of the Site and to temporarily or permanently eliminate, limit and prohibit access to it.
If the User believes that within the framework of the Services of the Site events occur that are contrary to the provisions of the present Legal Warning, the User must notify Sensofar by writing an e-mail to the following address: info@sensofar.com. Sensofar declares that it will do everything within its power to eliminate from the Site's Services any statements that violate any right or law as soon as possible after it receives notification of the fact, including the reasons and the identification of the sender.
Applicable law and jurisdiction
The present legal warning and any relation between the User and Sensofar will be governed by Spanish law.
